These Terms of Service (“Terms”) govern your use of the Viral AI – Video & Avatar mobile application and related services (the “Services”) operated by Viral AI (“we,” “us,” or “our”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. What the App does

Viral AI lets you replace a face in short sample videos from our catalog using a Face Photo you provide. The current version does not let you upload your own source videos. Store listings may describe future or broader capabilities; the in-app experience is limited to face swap on our sample catalog.

2. Eligibility

You must be old enough to use the Services under the laws of your country. If you are under the age of majority, you may use the Services only with permission from a parent or legal guardian who accepts these Terms on your behalf.

3. No account required

You are not required to create an account to use the free tier. Usage limits (such as daily Swap limits and queue limits) apply per device as described in the App.

4. Your content and responsibilities

You are responsible for Face Photos and exported videos you create. You agree that you will not:

• Use another person’s likeness without their permission or another legal right to do so.
• Create content that is illegal, harassing, defamatory, obscene, or that infringes intellectual property or privacy rights.
• Use the Services to impersonate others for fraud, harassment, or deception.
• Attempt to reverse engineer, scrape, overload, or disrupt the Services.
• Circumvent usage limits, quotas, or technical protections.

AI-generated output may be imperfect or unrealistic. You are solely responsible for how you share or publish exported videos, including complying with platform rules and disclosure expectations where required.

5. Our content

Sample videos, the App, branding, and related materials are owned by us or our licensors. We grant you a limited, non-exclusive, revocable license to use the Services for personal, non-commercial purposes unless we agree otherwise in writing.

6. Free tier and changes

We may change features, limits, sample catalog content, or availability at any time. We may introduce paid tiers in the future; current free-tier terms (including watermark-free export where offered) may change with notice where required.

7. Privacy

Our Privacy Policy explains how we handle information. By using the Services, you also agree to the Privacy Policy.

8. Third-party services

The Services rely on third-party infrastructure and service providers to operate. We are not responsible for third-party services outside our control.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR ACCURATE RESULTS FROM AI PROCESSING.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $10.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

11. Termination

You may stop using the Services at any time by uninstalling the App. We may suspend or terminate access if you violate these Terms or if we discontinue the Services.

12. Governing law

These Terms are governed by the laws applicable in our place of operation, without regard to conflict-of-law rules. Courts in that jurisdiction will have exclusive venue for disputes, except where consumer protection laws in your country require otherwise.

13. Changes

We may update these Terms. We will post the revised Terms on this page and update the “Last updated” date. Continued use after changes take effect constitutes acceptance.
